This physician makes you fill out a consent form for surgery. The language of the consent form allows the doctor to assume all rights of a proxy and more. It gives him the right to decide on whether to change your anesthesia while you are unconscious and without notifying your next of kin. Administer life saving methods without requesting permission from your proxy. It allows him to take any photo that he deems to be appropriate. It also allows for non-medical personnel to be present during your surgery. This is so broad scoped that a 6 year old child could be in surgery with you. According to the NYS Patient Bill of Rights, patients have the right to refuse observers to be present in the room and not to have photos taken. With today's internet; everyone should be aware that photos or video of your surgery can appear on the internet. And you can not even sue. You gave the doctor permission.

This surgery was performed on my wife, who was not aware of these special clauses. It was not explained to her as required by law.
